The Employee Free Choice Act is proposed legislation which, if passed, would amend significantly the National Labor Relations Act by changing the way unions are organized, the requirements for successful union organizing, and the penalties to employers for interfering with union rights. Although the Employee Free Choice Act has slipped from the headlines in recent months as the healthcare debate has taken center stage, its supporters vow that it is not dead. Many proponents of the Act are seeking to push a vote on it before the end of the year. While it is still unclear whether the Act will pass or what provisions it will contain if it does, employers would do well be prepared for the possibility of its passage, which could bring an onslaught of organizing campaigns that capitalize on the Act's provisions to move more quickly than ever before. This presentation will give employers the basic knowledge they need to be prepared to address such campaigns within the confines of the proposed law.
