What if an employee is using drugs at work? What if an employee is stealing from the workplace? Can you use a hidden camera to catch them in the act? For a long time the law was silent on this issue and issues like it. However, with new technology and increased employee autonomy, demands to protect employee privacy became louder and louder.
Three provinces, Alberta, British Columbia and Quebec, have already legislated in this area. And in the other provinces the common law is filing the gap. This session deals with the present state of the law when it comes to employee privacy. In addition to focusing on video surveillance, it deals with reading employee’s email, searching employee’s property, and tracking employee’s using GPS systems.
