Assessing Credibility in Workplace InvestigationsHuman resource professionals are often confronted with situations in which they must determine whether what someone is saying is credible. First, you will need some additional background that will be helpful when you go to sell your ADR proposal to your management team. Discrimination claims filed with the U.S. Equal Employment Opportunity Commission (EEOC) last year rose to the highest in the agency’s 44-year history, after a Supreme Court ruling that changed the way complaints may be filed.1 A record 95,402 claims were filed during the year ended Sept. 30, 2008, a 15 percent increase over the 2007 filings. More than 25 percent of claims filed contained an allegation of age discrimination while more than 34 percent of the filings included complaints of retaliation, according to the agency.2 The costs an employer will incur to resolve an EEOC charge can easily exceed $100,000. Any alternative that might reduce the number of claims proceeding to an EEOC charge or legal claim is well worth exploring.

Solutions you can’t delay: Proactive shields against overtime suits & the Employee Free Choice Act Possibly the two greatest concerns for employers at this time --overtime class actions and The Employee Free Choice Act ("EFCA") -- have one thing in common: Employers who are unprepared for these challenges will face significant and costly legal issues. An employer who has proactively audited his wage/hour practices and who is sued for overtime violations is often at the mercy of plaintiffs' lawyers. Similarly, upon passage of the EFCA, unsuspecting employers, who have not taken effective preventative measures, will have few successful options at their disposal. Fortunately, there are creative and effective strategies which can minimize and/or prevent wage hour class actions (with little to no change in operations), even for employers with a substantial history of non-compliance. Similarly, employers that institute prevention strategies before being faced with an organizing campaign under the EFCA are in a position to implement policies and strategies that render their workforce much less vulnerable to union advances. This webcast will provide employers the tools they need to institute preventative measures that can literally save millions of dollars.
